Terms and Conditions (T&C) for Chalet Enthofer

§ 1 Scope of Application

  • These T&C apply to all bookings and agreements with Chalet Enthofer.

§ 2 Definitions

  • Guest: Any person using the accommodation, including accompanying persons.
  • Contractual Partner: A natural or legal person concluding the accommodation contract.
  • Accommodation Contract: Agreement between Chalet Enthofer and the contractual partner.

§ 3 Conclusion of Contract

  • The contract is concluded upon the acceptance of the booking by Chalet Enthofer.
  • Chalet Enthofer may require a deposit. The booking becomes binding only after the deposit is paid. This deposit must be paid within 14 days of receiving the booking confirmation. The remaining balance is due no later than 30 days before the arrival date and must be credited to Chalet Enthofer’s account.
  • By paying the deposit, the contractual partner agrees to these T&C.

§ 4 Start and End of Accommodation

  • Check-in: From 4:00 PM, unless otherwise agreed.
  • Security-fee: €200 is required upon check-in and refunded after a damage-free return.
  • Check-out: By 10:00 AM. A late check-out may incur additional charges equivalent to one day’s stay.

§ 5 Cancellation by the Contractual Partner

  • Free Cancellation:
    Cancellations are free of charge up to 3 months before the arrival date.
  • Cancellation Fees:
    • 3 months to 1 month before arrival: 40% of the total price.
    • 1 month to 1 week before arrival: 70% of the total price.
    • Last week before arrival: 90% of the total price.
  • No-Show: If the guest does not arrive by 6:00 PM on the agreed arrival day, Chalet Enthofer is not obligated to provide accommodation unless a later arrival time has been agreed upon.

§ 6 Termination by Chalet Enthofer

  • Chalet Enthofer may terminate the contract up to 3 months before the arrival date for justified reasons (e.g., operational disruptions, unforeseen events).
  • If the deposit or the remaining balance is not paid on time, Chalet Enthofer is entitled to terminate the contract without notice.

§ 7 Substitute Accommodation

  • If necessary, Chalet Enthofer may provide equivalent substitute accommodation, provided it is reasonable and justified (e.g., in cases of overbooking or damage to the original accommodation).

 

§ 8 Rights and Obligations of the Contractual Partner

  • The contractual partner is entitled to use the booked rooms and facilities during the agreed times.
  • The contractual partner is liable for any damage caused by themselves, their guests, or accompanying persons.

§ 9 Rights and Obligations of Chalet Enthofer

  • Chalet Enthofer is obligated to deliver the agreed services in the booked quality.
  • Additional services not included in the accommodation price are charged separately.

§ 10 Liability of Chalet Enthofer

  • Liability for damage to deposited items is governed by §§ 970 ff. ABGB (Austrian Civil Code).
  • Chalet Enthofer is not liable for damages caused by the guest themselves.
  • In the event of compensation claims, Chalet Enthofer will pay a lump-sum settlement of 10% of the contract value. Upon acceptance of this payment by the guest, all claims shall be deemed settled. Further claims are excluded to the extent permitted by law.
  • For minor negligence, liability is limited to gross negligence or intent, particularly for business customers.

§ 11 Pets

  • Bringing pets is not permitted.

§ 12 Extension of Stay

  • An extension of the stay is only possible by mutual agreement.

§ 13 Place of Fulfillment, Jurisdiction, and Choice of Law

  • Austrian law applies.
  • The place of jurisdiction is the District Court of Rattenberg.
